1. Terms and Conditions 

• Governing Law: These terms are governed by the laws of Victoria, Australia

  
  

  Any disputes are subject to the exclusive jurisdiction of the Magistrates' Court of Victoria or the Victorian Civil and Administrative Tribunal (VCAT).
• Building Act 1993 (Vic): All installations for residential and office buildings must comply with the Building Act 1993 and Building Regulations 2018.
• Permit Responsibilities: Clients must ensure a Building Permit is obtained via a Registered Building Surveyor before work commences, as required by the Victorian Building Authority (VBA).
• Variations: Any changes to site specifications after the Quote Request may incur costs in line with the Domestic Building Contracts Act 1995 (Vic) for residential projects. 
  
  

2. Privacy Policy (Victoria Specific)

• Victorian Privacy Principles: In addition to the Federal Privacy Act 1988, we manage personal data in accordance with the Privacy and Data Protection Act 2014 (Vic).
• Health Records: For residential lift installations involving medical necessity, any health-related data is handled per the Health Records Act 2001 (Vic).
• Data Access: You have the right to access and correct your personal information by contacting us or the Office of the Victorian Information Commissioner (OVIC). 

3. Safety & Compliance (WorkSafe Victoria)

• OHS Act 2004 (Vic): All industrial and office installations must meet the Occupational Health and Safety Act 2004 and OHS Regulations 2017.
• Plant Registration: Certain goods lifts are classified as "prescribed plant" and must be registered with WorkSafe Victoria under Part 3.5 of the OHS Regulations.
• Hazardous Manual Handling: Our solutions are designed to comply with the WorkSafe Victoria Compliance Code: Hazardous Manual Handling to reduce musculoskeletal injuries.
• Technical Standards: We adhere to AS 1735 (Lifts, Escalators, and Moving Walks) as mandated by the National Construction Code (NCC) in Victoria. 
  

4. 12-Month Warranty Policy (ACL Compliant)

• Consumer Guarantees: Our 12-month warranty operates alongside the automatic guarantees provided under the Australian Consumer Law (ACL).
• Mandatory Text: "Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage".
• Victoria Implied Warranties: For residential installations, we provide implied warranties under the Domestic Building Contracts Act, ensuring work is performed with "reasonable care and skill".
